1. COOKIES AND OTHER TECHNOLOGIES
We use cookies and other, similar mechanisms to understand how users use our Website and for marketing purposes, including to display advertisements to them in other places on the Internet.
What are cookies?
A cookie is a small text file, saved by a website on your computer, phone or other device on which you browse the website. A cookie contains data about your use of this site.
Some cookies are necessary for the operation of our Store and cannot be disabled.
In other cases, when you first visit our Website, we ask you to provide
consent for the installation of cookies. We do not use advertising or analytical cookies (or any
others
than necessary) without your consent.
Which cookies do we use?
- Essential cookies
- These cookies are used for the proper functioning of the site. You cannot disable them because after disabling them our site simply will not function properly.
- In this regard, we use a tool that stores your privacy settings. It shows your consent or lack thereof to the running of individual types of cookies on our site.
- Other essential cookies on our Website are used for its proper functioning and for managing it, including for making changes to the site and for running tracking tools to which you consent.
- Statistical analysis of our Website
- We use tools that collect analytical data, which allow us to understand how users use our Website. The data we receive from these tools does not provide us with information about a specific person known by name and surname, but allows us to record various aspects of the use of the Website by a given user. We can aggregate and analyze this data statistically, and then use it to make decisions about changes in our Store and/or in the ways we conduct our advertising and marketing communication.
- A list of the analytical tools we use on the Website along with an explanation of: (1) who the tool provider is, (2) what exactly it is used for, (3) what data is collected as part of a given tool – you will find in Appendix No. 1 to this policy, and in summary also in the cookie consent management panel.
- We use advertising tools through which we can display our advertisements on other websites you visit, including social media (so-called targeted advertisements), measure the effectiveness of our advertising campaigns, and tailor the content of our messages addressed to you to the information we have about you.
- In the Shop, we enable signing up for our newsletter. Consequently, cookies are used to embed a subscription form on our Website and measure the effectiveness of sign-ups in this form. Modern e-mail marketing systems allow us to link analytical data from mailing campaigns with analytical data from the Shop. We may use this data to optimise the content of messages sent to newsletter subscribers.
- A list of the advertising tools we use on the Website, along with an explanation of: (1) who the provider of the tool is, (2) what exactly it is used for – can be found in Annex No. 1 to this policy, and in brief also in the cookie consent management panel.
- Some cookies on our website are used to run additional tools on the Shop's site, such as a chat, a module for adding product reviews and/or stars, the ability to recommend a product to a friend, the ability to display products you have recently viewed in our Shop, etc.
- A list of the functional tools we use on the Website, along with an explanation of what exactly they are used for, can be found in the cookie consent management panel.
- On our Website, we have included links to our social media profiles: Facebook / Instagram / TikTok / LinkedIn / Twitter. If you visit our profile on a given service, the owner of that service will receive – just as in the case of users moving from any other website to another website – information that you reached those services from our Store.
- Details regarding the processing of data by these social media services can be found
on the pages of the providers of these services:
- Facebook and Instagram - https://www.facebook.com/privacy/center/
- TikTok - https://www.tiktok.com/legal/page/eea/privacy-policy/pl-PL
- LinkedIn – https://privacy.linkedin.com/
- Twitter – https://twitter.com/en/privacy
- In the Store, we use social media plugins that allow, for example, sharing a
product from our Store on your profile / liking our product on
Facebook, saving graphics from our Website to your account on
Pinterest. Using such plugins involves transferring information from cookies to the owners of these
social media services:
- the service provider will receive information that your browser has displayed our Website, even if you are not logged into the given social media service, or do not even have a profile on it;
- if you logged into one of the aforementioned social media services before visiting our Store, its owner will be able to directly assign the visit to our Website to your profile in that service.
- If you do not want social media services to assign data collected during your visit to the Store to your social media profile, before visiting our Website, log out of these services. You can also completely prevent social media plugins from loading on our Website by selecting the appropriate settings in the cookie consent management panel.
- Some videos on the Website are embedded using plugins from the YouTube service [a service owned by Google] / plugins from the Instagram service [owned by Meta Platforms] / plugins from the TikTok service. When you play such a video on our Website, Google / Instagram / TikTok receives information about this from your browser, even if you do not have a Google/YouTube profile / even if you do not have a profile on the Instagram service / even if you do not have a profile on the TikTok service, or are not currently logged in. If you have previously logged in to the aforementioned service, this service provider will be able to directly associate the video playback with your profile.
- If you want to prevent Google / Instagram / TikTok from collecting information about your
activity
on our Website, you can:
- not play the video (Giving consent to play the video will be treated as consent also regarding other videos on our Website – until you withdraw it, i.e., change your cookie choices),
- not consent to cookies from this service on our Website,
- or you can log out of this service.
- More information about data processing by the YouTube / Instagram / TikTok service can be found at https://www.youtube.com/account_privacy / https://help.instagram.com/help/instagram/1896641480634370/?locale=pl_PL / https://www.tiktok.com/legal/page/eea/privacy-policy/pl-PL.
- Some videos on the Website are embedded using plugins from the Vimeo service. Consequently, cookies from this service are used on our Website, but they are not used for advertising or analytical purposes (they do not track your playback of videos in our Store).
- More information about data processing by the Vimeo service can be found at https://vimeo.com/cookie_policy.
Legal issues regarding cookies
The legal basis for the Shop to use necessary cookies (indicated above in the section „What cookies
do we use?”) is our legitimate interest, i.e. the right to run a Website
supporting
our business, and the necessity to maintain its security.
The legal basis for our use of other cookies is your consent.
In connection with our processing of your personal data using cookies, at any time you are entitled to the rights about which we write in the section Your rights in connection with data processing.
Our use of cookies, in particular for advertising purposes, may involve so-called profiling. This means that we or the marketing companies whose services we use may create a user profile on the basis of the information collected (e.g. e-mail address, order history, type of device, used technology, frequency of visits) and on this basis formulate purchase forecasts for the future. It allows us to make decisions about what content (including advertisements) to display on our and other websites.
How long do cookies remain on the user's device?
It depends on whether they are „persistent” or „session” files. Session cookies, i.e. information necessary for the browser functionalities to work correctly, expire after the end of the user's session, i.e. each time you close our Site. Persistent cookies, thanks to which use of the site is easier (e.g. they remember the selected resolution, content layout, user preferences, recently viewed products) will be stored longer by the browser and will remain there until the date of expiry, unless you delete them yourself earlier using the settings in the browser menu.
Third-party cookies (i.e. analytical, advertising and social media related) are subject to their own privacy policies, to which we provide you with links in this policy.
2. Other purposes of processing personal data of Shop users
What data do we process and for what purposes?
In addition to the cookies described above, we process your following data for the following purposes related to the functioning of the Shop:
Order details and fulfilment history.
Correspondence history.
Identification data of the person submitting /publishing the review /comment.
Invoice details.
Statistical data related to messages sent, including open rate history.
Providing the above data by you is not mandatory, however it is necessary to fulfil your order, issue an invoice to you, notify you of the order status, respond to your enquiry or complaint, etc.
The collection of data for the purposes of performing accounting and tax obligations, as well as the transfer of data to the National e-Invoice System (KSeF) takes place solely to the extent required by law and does not require separate consent from the Shop's customer.
How long do we process the data?
We process your data related to placing an order in the Shop for as long as it is necessary to complete the order, and until the expiry of the period specified in the tax law regulations.
Structured invoices sent to KSeF are stored in KSeF for a period of 10 years, counting from the end of the year in which they were issued.
In addition, we will process the data for the time necessary to achieve the goals listed above in the table (and thus until the cessation of our legal interest enabling us to process, or until the time you object to the processing, or possibly until the time you withdraw your marketing consent – if you have provided such). Further processing will only be possible in the event that we, as the controller, are subject to such a legal obligation (in particular for tax purposes) and potentially for archival purposes to protect ourselves against possible claims (until the limitation period for such claims expires).
To whom do we transfer your data?
In our business, we use the services of other cooperating companies, therefore your data may be entrusted by us to: the company providing us with software to run the Shop, an accounting firm, the hosting provider of our Website, the hosting provider of our email, an email marketing system provider, other companies whose marketing services and tools we use. Your data is also transferred to courier companies and, if applicable, payment intermediaries in order to fulfil your order, whereby these companies are separate controllers of personal data.
To the extent that tax law regulations require the issuance of a VAT invoice, information contained in VAT invoices is transferred to the National e-Invoicing System (KSeF), administered by the National Revenue Administration. Access to VAT invoices in KSeF is granted to entities authorised under the law, in particular the authorities of the National Revenue Administration. In connection with the use of KSeF, we may grant permissions to use KSeF (in particular to view/receive invoices) to entities supporting us in the implementation of accounting obligations, e.g. an accounting office, in accordance with the rules for granting permissions in KSeF.
We participate in a customer satisfaction / customer feedback survey programme. If you consent to being included in such a survey, your data will be shared with the organiser of the customer satisfaction survey system. This entity is a separate controller of your personal data.
For the purposes of the marketing activities described above in the “Cookies” section, we use services provided by entities based in the USA (Google, Facebook). In connection with the above, personal data may be transferred to third countries that are not members of the European Union. An appropriate level of protection for your data is ensured by the Data Privacy Framework programme, of which you can read more at https://www.dataprivacyframework.gov/s/.
Your rights in connection with data processing
We are committed to respecting the confidentiality of your personal data and to guaranteeing that you can exercise your rights. You may exercise your rights at no cost to you by sending us an e-mail message or contacting us in any other way.
Please remember that in connection with the processing of your data, you have the right to:
- request access from Us to the data we hold about you;
- rectify your data;
- erase your data if they are no longer needed for the purposes for which they were processed, or if we have no other legal basis for processing them;
- withdraw consent for the processing of your personal data, if you have given such consent;
- object to the processing of your data if we process them on the basis of a legitimate interest;
- restrict data processing;
- lodge a complaint with the President of the Personal Data Protection Office if you believe that your data are being processed unlawfully by us.
Additional information for newsletter subscribers
If you have signed up for our newsletter, we will send you marketing information regarding our products and/or services, e.g. about news in our offer, promotions, or special offers.
You can unsubscribe at any time by clicking the link found in each newsletter or simply by writing us a message.
A modern email marketing system allows us to analyse recipient actions, i.e. it provides us information, as to whether a given message was opened by you. We analyse such information to better tailor the content of the newsletter and notifications to your interests and to send you personalised messages (profiling). You can object to such processing of your data by us at any time. In the case of subscriber inactivity for 1 year we may stop sending the newsletter to them. In such a case, we will remove you from the list of our subscribers (with additional notice).
Your data is not used by us to make decisions based on automated data processing, which could affect your legal situation or cause other similarly significant effects for you.
Further legal information about the rules for sending our newsletter can be read in the Newsletter Terms and Conditions (part of our Store Terms and Conditions).
APPENDIX NO. 1 TO THE STORE PRIVACY POLICY mejbe.com
- LIST OF ADVERTISING AND ANALYTICAL TOOLS USING COOKIES
- We use Google Analytics
- Information collected by Google Analytics about users includes, for example: how many times a user visits the website; which subpages they visit; date of the first and last visit; duration of visits; the page, from which the user visited the website (referral source); the browser the user uses; the link, which was clicked; the place in the world from which the user accesses it, an anonymised (shortened) IP address, etc.
- Google assigns its own identifier (the so-called Google ID) to individual users and collects on its servers data obtained from cookies from various websites. We – as the owner of the Website – can receive reports (statistics) from Google related exclusively to traffic on our Website. These reports, of course, only cover individuals who have expressed their consent on our Website to having their visits recorded by Google Analytics.
- Further detailed information on how Google Analytics works can be found at https://policies.google.com/technologies/partner-sites and https://support.google.com/analytics/answer/6004245/bezpiecze%C5%84stwo-danych.
- You can also permanently prevent Google Analytics from recording information coming from your browser by installing a special plugin located at https://tools.google.com/dlpage/gaoptout.
- We use the Hotjar tool
- This tool records data regarding user behaviour on the Website such as: user navigation on the site, page scrolling, cursor movement, approximate location, device used, operating system, browser type. The data obtained in this way is processed in an aggregate and anonymised manner – in order for us to improve the way our Website functions.
- More information on how the Hotjar tool works can be found at https://www.hotjar.com/privacy/.
- You can block Hotjar from measuring your activity by using the link https://www.hotjar.com/policies/do-not-track/.
- Cookies of our Store's software provider
- The software provider through which our Store operates - i.e. the owner of the shoper.pl platform - places cookies on our Website in order to collect aggregate information about how customers use online stores (subpages opened and time spent on them, displayed products, clicks on the Store website, analytical information regarding purchases, e.g. conversion rates).
- This data is used to create aggregate reports for e-store owners, containing general (without personal data) information, including which products interest customers of a given store, at what time of year there is increased traffic or sales in stores, etc. This allows sellers (including us) to improve their stores and optimise sales processes.
- Full information on this subject can be read in the Cookie policy for visitors to Shoper stores.
-
We use Google Ads and other Google advertising tools
- Google collects data obtained from cookies placed on your device on its servers. This data is collected on all pages where you have allowed the use of cookies for advertising purposes by Google (including our Website), as well as from ads you have clicked on. Google uses this information to display advertisements on other pages you visit. Typically, Google cookies expire after 3 months.
- As advertisers using Google services, we do not have access to data from cookies stored on your device, but we can commission advertisements to groups of recipients with characteristics selected by us, e.g. to all people who have visited our website (or its specific subpage) within the last 7 days. This data is only statistical material for us, and we commission advertisements only on the basis of aggregate criteria (to specific target groups, rather than to a specific user).
- We can also use (as part of using the Google Marketing Platform) tools enabling the measurement of advertising campaign effectiveness (e.g. how many people clicked on a given ad at a specific time).
- You can read more about how Google uses cookies to display advertisements and how you can manage your advertising settings at the following addresses https://policies.google.com/technologies/ads?hl=pl and https://support.google.com/adsense/answer/7549925?hl=pl.
- Meta conversion pixel (Facebook and Instagram)
- We use the so-called „conversion pixel” (remarketing pixel) from Meta to manage advertisements on Facebook and Instagram portals.
- If you consent to the use of this cookie on our Website, then through this tool, Meta Platforms services obtain information that you have visited our Website. This information is assigned to your profile in the respective service, if you have it. If you are not a user of these services, the information is assigned to the so-called „Facebook ID” created for you.
- This allows us to commission advertisements on Facebook and Instagram for those who have already visited our Website or its individual subpages (remarketing). Subsequently, we receive only statistical data from Meta Platforms regarding the effectiveness of advertisements (e.g. how many people saw our ad, how many people clicked on it), without reference to specific users.
- If you have an account on Facebook or Instagram, we encourage you to read further information on data protection in these services on the pages https://www.facebook.com/privacy/policy/?entry_point%3Ddata_policy_redirect%26entry%3D0&sa=D and https://help.instagram.com/155833707900388.
- You can read more about the Meta remarketing pixel itself on the page https://www.facebook.com/business/help/742478679120153?id=1205376682832142.
-
Email marketing
- For newsletter purposes, we use a tool provided to us by an external company.
- The email marketing system embeds cookies on our Website to display subscription forms and to measure the effectiveness of these forms (conversion rate).
